Agreement to Our Legal Terms

Blabytes UG (haftungsbeschränkt), a German company located at Königsberger Straße 18, Kriftel, Hessen 65830 (VAT: DE450632412), operates the BlablaPal mobile application and related services.

BlablaPal is an AI-powered language-learning app. It enables users to chat with artificial personas in a target language, read and listen to articles, look up and train vocabulary, work through grammar and practice exercises, practise speaking using the device microphone, and track their own learning progress.

These terms constitute a binding agreement between you and the company. By accessing services, you acknowledge reading and agreeing to all terms.

Age Requirement: Services are restricted to users aged 16 and older. If you are under 18, you may only use the services with the consent of a parent or legal guardian, and any purchase requires their consent.

If you are a consumer, nothing in these terms takes away rights the law gives you. Where a clause here says less than the law grants you, the law applies. See sections 21, 24 and 25.

1. Our Services

Service information is not intended for distribution in jurisdictions where such distribution violates law or regulation. Users accessing services from other locations assume responsibility for local legal compliance.

The services are for language learning and general education. They are not a medical, legal, financial, diagnostic, or certification service, and they do not provide a recognised language certificate or examination.

What you need in order to use the services

  • A supported device. iPhone or iPad with iOS 15.6 or later, or an Android device with Android 7.0 or later. A current browser can be used for the web version at blablapal.com/app.
  • An internet connection. The services are cloud-based: chats, articles, exercises, translations, and spoken audio are generated on our servers and at our AI providers while you use the app. Nothing meaningful works offline. Any mobile data cost is yours.
  • A user account. You need an account with an email address (see section 5) to use the app, including the free allowance.
  • A microphone, if you want to use the speaking exercises. You grant access in your device settings and can withdraw it there at any time; the rest of the app keeps working without it.
  • An app store account with Apple or Google, if you want to take out a subscription (see section 7).

What you enter in the app is transmitted to third-party AI providers so that they can generate the response. Section 2 and our Privacy Policy explain this in detail.

2. AI-Generated Content

BlablaPal is an artificial-intelligence service. The chat personas, corrections, explanations, exercises, generated articles, translations, and spoken audio are produced by AI language and speech models. You are never communicating with a human being, even where a chat partner is presented with a name, a picture, and a personality.

To provide these features, the text you enter — chat messages, words you look up, exercise answers, article requests — and, where you use the speaking features, the audio you record, are transmitted to specialist third-party AI providers that process this data on our behalf, under contract and on our instructions only. The providers we currently use are named individually in our Privacy Policy, which also explains how long the data is kept and what rights you have over it.

Accuracy: AI output can be wrong, incomplete, outdated, or misleading. This includes translations, grammar corrections, level assessments, and any factual statement made by a chat persona or contained in a generated article. The services are provided for language practice only. Do not rely on AI output as professional advice of any kind — in particular medical, legal, or financial advice — and verify anything that matters against an authoritative source.

No training on your content. We do not use what you write, say, or look up in the app to train or fine-tune AI models, and we have contractually excluded such use with every AI provider we commission and name in our Privacy Policy. Your inputs are sent to those providers only to generate your answer and are not retained by them to improve their models. One exception applies: the speech recognition built into your device's operating system follows the terms of the device manufacturer rather than our agreements, so we cannot exclude such use there. Our Privacy Policy explains this. We do use anonymous, aggregated usage statistics — for example how often a feature is opened — which contain no content and no personal data.

The content generated for you. We make no ownership claim against you in respect of the articles, exercises, corrections, translations, and audio the services generate in your account. You may use them for your own learning, including outside the app, subject to the restrictions in section 3 on our own Content and Marks. Because AI models produce similar output for different users from similar inputs, we cannot promise that generated output is unique to you, that it is free of third-party rights, or that it is protected by copyright at all.

Your responsibility: You must not use the AI features to generate unlawful content, to attempt to extract, alter, or circumvent the underlying system instructions or models, or to use the services as a general-purpose AI interface for purposes unrelated to language learning.

3. Intellectual Property Rights

Our Intellectual Property

The company owns or licenses all intellectual property in the services, including source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics (collectively "Content"), plus trademarks, service marks, and logos (the "Marks"). Content and Marks are provided for personal, non-commercial use exclusively.

Your Use of Our Services

Subject to compliance with these terms, you receive a non-exclusive, non-transferable, revocable licence to access the services and download or print Content for personal, non-commercial use only. No Content or Marks may be reproduced, distributed, sold, or exploited for commercial purposes without express prior written permission.

Your Submissions and Contributions

If you send us feedback, suggestions, bug reports, or similar ideas about the services ("Submissions"), you grant us the right to use them freely and without compensation to improve the services. This applies only to such feedback. It does not apply to the content you create inside the app, which is covered by Section 13 (Contribution Licence).

4. User Representations

By using the services, you represent and warrant that:

  1. All registration information is true, accurate, current, and complete
  2. You will maintain registration information with timely updates
  3. You are at least 16 years old, and if you are under 18, your parent or legal guardian consents to your use of the services
  4. You possess the legal capacity to enter into this agreement and agree to comply with these terms
  5. You will not access the services via automated or non-human means
  6. You will not use the services for illegal or unauthorized purposes
  7. Your use will not violate any applicable law or regulation

5. User Registration

You must register in order to use the services. You must keep your password confidential and bear responsibility for all account activity. The company reserves the right to remove or change usernames deemed inappropriate or objectionable at its sole discretion.

6. Products

All products are subject to availability. Product pricing is subject to change in accordance with section 8. Discontinuing a product or feature is governed by section 20.

7. Purchases and Payment

How purchases are processed: A subscription can be bought in two ways, and the seller differs:

  • In the iOS or Android app: as an in-app purchase through the Apple App Store or Google Play. Apple or Google is the seller of record: the purchase contract for the subscription is concluded with the respective app store, which collects payment using whichever payment method you have stored with them.
  • On our website (blablapal.com): through our online reseller Paddle, who is the seller (Merchant of Record) for purchases made there. The purchase contract is concluded with Paddle — Paddle.com Market Limited, 30 Old Bailey, London EC4M 7AU, United Kingdom, or the Paddle company named in the checkout for your country — which collects payment, issues your invoice, and handles the applicable taxes. Paddle's buyer terms apply to that purchase.

In both cases we never receive, process, or store your payment details. Whichever way you buy, what the subscription unlocks, how it renews, and the fair-use limits are governed by these terms. A subscription belongs to your BlablaPal account, not to a device: bought on the website, it is also active in the apps, and vice versa, as long as you sign in with the same account.

Prices are set in Euro and are converted and displayed by the respective app store or by Paddle in your local currency; the amount actually charged, and any applicable taxes, are determined by that store or by Paddle for your country. You agree to keep the account and payment information stored with your app store or with Paddle current, complete, and accurate. The company reserves the right to correct pricing errors even if payment has already been processed.

8. Subscriptions

Free Features

BlablaPal is free to download, and you can try the app without any payment information. Without a subscription you get a limited free allowance, currently: up to 100 words per day written in chat, three practice sessions and three grammar training rounds in total, 50 saved vocabulary items per target language, and one article you create yourself. Reading and listening to the articles provided in the app and practising with flashcards are not limited. These allowances are shown in the app and may change over time; the values displayed in the app at the time of use apply.

Premium Subscription

A subscription unlocks the app's features beyond the free allowance, subject to the fair-use limits set out below. By subscribing, you consent to recurring charges to your chosen payment method until cancellation.

Free Trial

New subscribers may be offered a free trial. Its length depends on where you subscribe and on the plan you choose; it is shown on the purchase screen before you subscribe, together with whether you are eligible. The trial is granted by the app store or, for purchases on the website, by Paddle, and only once: per store account and subscription group in the app stores, per customer on the website. During the trial you have full access to the subscription features, subject to the same fair-use limits.

A trial turns into a paid subscription automatically when it ends, at the price shown at purchase, unless you cancel at least 24 hours before it expires. Cancellation works as described under Cancellation below. If you subscribe before the trial ends, the unused part of the trial lapses.

Fair Use

Every chat message, generated article, and spoken sentence causes real cost at our AI providers. Subscriptions are therefore intended for normal personal learning use and are subject to fair-use limits — in particular on the number of articles generated per calendar month and on the volume of chat. The limits in force are shown in the app before you subscribe. A single chat message may not exceed 100 words.

We may introduce or adjust further reasonable limits — for example a monthly cap on overall chat volume — in order to protect the service against abuse, automated use, and excessive consumption. Any such limits are set so that ordinary personal use is not affected, and the limits in force are always shown in the app. Changing them is a change to the services and follows section 20. If you reach a limit through genuine personal use, contact legal@blablapal.com.

Billing and Renewal

Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date.

Cancellation

To cancel a subscription bought in the app: open your device settings, go to your account (Apple ID for iOS or Google Account for Android), navigate to Subscriptions, select BlablaPal, and confirm cancellation.

To cancel a subscription bought on the website: use the link in the confirmation email you received from Paddle, or submit a cancellation request at paddle.net. You can also write to legal@blablapal.com and we will arrange the cancellation for you.

In both cases cancellation takes effect at the end of the current paid billing period, and your account and learning content remain in place as a free account afterwards. Deleting your account is separate and is described in section 19. Questions? Contact legal@blablapal.com.

Fee Changes

We may change the price of a subscription for future billing periods. We will inform you of a price change at least 30 days before it takes effect, by email or in the app, and tell you how to cancel. The new price applies only from the next billing period after the notice, and only if you have not cancelled by then. A price increase never applies retroactively to a period you have already paid for.

9. Right of Withdrawal and Refunds

Who handles a withdrawal or a refund depends on where you bought the subscription.

Purchases in the app: Apple or Google is the seller of record for your purchase. Your statutory right of withdrawal for that purchase, and the information about it, therefore come from the store, which obtains any declarations required for it during the purchase process. We cannot issue a refund for an app-store purchase ourselves:

  • Apple App Store: You may request a refund or exercise your right of withdrawal through Apple at reportaproblem.apple.com. Apple reviews each request individually.
  • Google Play: You may request a refund through Google Play within 48 hours of purchase, and exercise a statutory right of withdrawal through Google's support channels. After 48 hours, you can also contact us at legal@blablapal.com and we will pass on and support your request.

Purchases on the website: Paddle is the seller of record for your purchase. Your right of withdrawal for that purchase, and the information about it, come from Paddle and are set out in Paddle's buyer terms and refund policy: you may withdraw within 14 days of the purchase without giving reasons, unless you agreed during checkout that the subscription is made available to you straight away and have started using it within those 14 days. You declare a withdrawal or request a refund at paddle.net or by email to help@paddle.com; you can also write to legal@blablapal.com and we will pass on and support your request.

Consumers in the EU/EEA: You have a statutory right to withdraw from a contract for digital content within 14 days, without giving reasons. Since the store or Paddle is your contractual partner for the purchase, you exercise that right against them. Should we at any point sell subscriptions ourselves rather than through an app store or a reseller, we will provide separate withdrawal instructions and a model withdrawal form at that time, before you buy. Your statutory rights in relation to the services themselves, in particular the rights under sections 24 and 25, are unaffected and are exercised against us.

For questions about billing or a refund, contact legal@blablapal.com.

10. Software

Software included for service connection may include end user licence agreements (EULAs). Unlicensed software receives a non-exclusive, revocable, personal, non-transferable licence for use in connection with the services. Section 24 applies to the condition of that software.

11. Prohibited Activities

Services may not be accessed or used for purposes other than those for which they are made available. You agree not to:

  • Systematically retrieve data to create collections or databases without written permission
  • Trick, defraud, or mislead the company or other users
  • Circumvent or interfere with security-related features of the services
  • Make untrue statements of fact that damage the company or its services
  • Use service-obtained information to harass, abuse, or harm others
  • Use the services inconsistently with applicable laws or regulations
  • Upload viruses, Trojan horses, or other malicious materials
  • Engage in automated use such as scripts, data mining, or scraping tools
  • Attempt to impersonate other users or persons
  • Interfere with or disrupt the services or connected networks
  • Decompile, disassemble, or reverse engineer any service software, except to the extent such acts are permitted by mandatory law
  • Use the services for any revenue-generating or commercial enterprise purposes
  • Sell or transfer your profile to any other person
  • Post hateful, violent, sexually explicit, or otherwise objectionable content
  • Infringe copyright, trademark, or other intellectual property rights
  • Engage in phishing, fraud, impersonation, or spamming
  • Collect, use, or share others' personal information without consent

12. User Generated Contributions

The app lets you create and store your own content in your account — for example custom chat partners, your own chat messages, vocabulary lists and notes, requested articles, and audio you record in speaking practice — and to send us bug reports and feedback. This content is referred to as "Contributions".

BlablaPal has no public feed, no public profile, and no sharing between users. Your Contributions are visible to you and are processed only in order to provide the services to you. By submitting Contributions, you represent and warrant that:

  • Your Contributions do not infringe third-party intellectual property rights
  • You own or have the necessary rights to submit the Contributions
  • Your Contributions are not false, inaccurate, or misleading
  • Your Contributions are not obscene, harassing, or otherwise objectionable
  • Your Contributions comply with all applicable laws and regulations

13. Contribution Licence

You keep all rights in your Contributions. You grant us only the licence we need in order to run the service: a non-exclusive, worldwide, royalty-free licence to store, reproduce, transmit, display back to you, and process your Contributions, including passing them to the third-party providers listed in our Privacy Policy, for the sole purpose of operating and providing the services to you.

This licence does not permit us, or those providers, to train or improve AI models on your Contributions, to publish them, or to use them for advertising. See section 2.

This licence ends when you delete the relevant content or your account, except for backup copies still in rotation and for records we are required by law to retain.

14. Mobile Application Licence

Service access via app grants a revocable, non-exclusive, non-transferable, limited right to install and use the app on your own devices strictly in accordance with these terms. The same licence covers the version of the app that runs in your browser on our website, without installation. You shall not:

  1. Decompile, reverse engineer, or attempt to derive the source code of the app, except to the extent such acts are permitted by mandatory law
  2. Make modifications or create derivative works from the app
  3. Violate applicable laws or regulations in connection with the app
  4. Remove or obscure any proprietary notices in the app
  5. Use the app for revenue-generating or commercial purposes
  6. Make the app available on networks permitting simultaneous multi-device access
  7. Use the app to create products or services that compete with BlablaPal

Additional terms for the Apple App Store

The following applies to the app if you obtained it from the Apple App Store, and applies in addition to the rest of these terms.

  1. This agreement is with us, not Apple. These terms are concluded between you and Blabytes UG (haftungsbeschränkt) only. Apple is not a party to them. We alone, and not Apple, are responsible for the app and its content.
  2. Scope of the licence. The licence granted for the app is a non-transferable licence to use the app on any Apple-branded product that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the app may be accessed by other accounts associated with you through Family Sharing or volume purchasing.
  3. Maintenance and support. We are solely responsible for providing any maintenance and support services for the app. Apple has no obligation whatsoever to furnish maintenance or support services for the app.
  4. Warranty. In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app to you, if any. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the app. This does not affect your statutory rights against us under section 24, which are in no way limited by it, and it does not concern subscriptions, which are dealt with in sections 7 to 9.
  5. Product claims. We, and not Apple, are responsible for addressing any claims by you or a third party relating to the app or your possession and use of it, including product liability claims, any claim that the app fails to conform to a legal or regulatory requirement, and claims arising under consumer protection, privacy, or similar legislation.
  6. Intellectual property claims. In the event of a third-party claim that the app or your possession and use of it infringes that third party's intellectual property rights, we, and not Apple, are solely responsible for the investigation, defence, settlement, and discharge of that claim.
  7. Legal compliance. You represent and warrant that you are not located in a country subject to a US Government embargo or designated by the US Government as a "terrorist supporting" country, and that you are not listed on any US Government list of prohibited or restricted parties.
  8. Third-party beneficiary. Apple and Apple's subsidiaries are third-party beneficiaries of these mobile application licence terms and, upon your acceptance of these terms, have the right to enforce them against you as a third-party beneficiary.

For apps obtained from Google Play, the Google Play Terms of Service apply in addition. Google is a third-party beneficiary of these mobile application licence terms.

15. Third-Party Sign-In

You can create an account and sign in either with an email address and password, or using your Google Account or Apple ID. If you sign in with Google or Apple, that provider confirms your identity to us and shares a limited set of profile information — such as your email address — in line with your settings there. We do not post anything on your behalf and receive no access to your contacts, files, or other content.

Your relationship with Google or Apple is governed solely by that provider's own terms. You can revoke the connection at any time in your Google or Apple account settings.

16. Services Management

The company reserves the right (but not the obligation) to monitor services for violations, take appropriate legal action, restrict or disable user contributions, and otherwise manage the services to protect the company's rights and ensure proper functioning. Restricting or terminating your access is governed by section 19.

17. Privacy Policy

The company cares about data privacy and security. Please review our Privacy Policy. Use of the services constitutes agreement to the Privacy Policy, which is incorporated into these Legal Terms.

The company respects third-party intellectual property rights. If you believe that material available through the services infringes a copyright you own or control, please notify us immediately at legal@blablapal.com. Note that misrepresentation in a copyright infringement notification may create liability under applicable law.

19. Term and Termination

Term

The user agreement begins when you register and runs for an indefinite period. A subscription runs for the billing period you chose and renews as described in section 8.

Your right to terminate

You can terminate the user agreement at any time and without giving reasons by deleting your account in the app under Account → Delete account, or by writing to legal@blablapal.com. If you no longer have the app installed, you can use our account deletion page.

Deleting your account ends the agreement immediately and deletes your learning content — your chats, vocabulary, notes, articles, recordings, and progress — as described in our Privacy Policy. This cannot be undone, so export or note down anything you want to keep first. Deleting your account does not by itself cancel a running subscription: cancel that with Apple or Google as described in section 8, otherwise the store will keep charging you. Fees already paid for the current billing period are not refunded if you terminate the agreement yourself without cause.

Our right to terminate

We may terminate the user agreement of a free account by giving you 30 days' notice in text form, for example if we discontinue the services.

For an account with a running paid subscription, we may terminate before the end of the paid period only for good cause. Good cause exists in particular if you seriously or repeatedly breach these terms, use the services unlawfully, attempt to circumvent technical limits or security features, or use the AI features in a way that is automated or so excessive that it materially harms the service for others. Where reasonable, we will warn you first and give you an opportunity to put things right.

If we terminate an account with a paid subscription for a reason you are not responsible for, we will refund the fees for the remainder of the paid period pro rata. Since Apple and Google collect the payment, we will arrange the refund through the relevant store or, where that is not possible, pay it out directly.

Suspension

Instead of terminating, we may temporarily restrict or suspend access where this is necessary to avert an immediate risk to the security or integrity of the services. We will lift the restriction as soon as the reason for it no longer applies and will tell you why we imposed it.

After termination

We will give you at least 30 days from a termination notice by us to export or request a copy of your learning content before it is deleted, unless we are required by law to delete or retain it sooner. Sections 3, 13, 25, 26, and 30 survive the end of the agreement.

20. Changes to the Services

Updates. We keep the services in conformity with the agreement for the duration of the agreement, and we will supply the updates, including security updates, needed for that purpose (§ 327f of the German Civil Code). We will tell you about such updates and how to install them.

Other changes. We may also change the services beyond what is needed to maintain conformity — for example add, alter, or remove features, adjust the AI models used, or change usage limits. We will only do so for a valid reason: to adapt to a new technical environment, to a change at one of our providers, or to a change in the law; to protect the security or integrity of the services; or to develop the product further. Such a change will not cost you anything extra.

If a change affects you negatively. If a change more than insignificantly impairs your access to, or use of, the services, we will inform you in text form at least 30 days in advance, describing what will change and when. In that case you may terminate the agreement free of charge within 30 days of receiving the notice, or of the change being made if that is later, and we will refund the fees for the remainder of the paid period pro rata. This does not apply if we give you the option, at no extra cost, of keeping the services unchanged in a way that maintains conformity.

Availability. We aim to keep the services available continuously, but cannot guarantee it. Maintenance, technical faults, and outages at our providers can cause interruptions, delays, or errors. We will announce planned maintenance in advance where reasonably possible and keep it short. Our liability for outages is governed by section 25.

Discontinuation. If we discontinue the services entirely, we will give you at least 30 days' notice in text form, refund prepaid fees for the remaining period pro rata, and give you the opportunity to export your learning content.

21. Governing Law

These Legal Terms are governed by German law, with the UN Convention on Contracts for the International Sale of Goods excluded. If you are a consumer, this choice of law does not deprive you of the protection of the mandatory provisions of the law of the country in which you are habitually resident.

If you are a merchant, a legal person under public law, or a special fund under public law, the courts in Frankfurt am Main, Germany have jurisdiction. If you are a consumer, the statutory rules on jurisdiction apply: you can bring proceedings against us at the court for your place of residence or at our seat, and we can bring proceedings against you only at the court for your place of residence.

22. Dispute Resolution

If you have a complaint, please write to legal@blablapal.com first. Both sides agree to try to settle a dispute informally for at least thirty (30) days from written notice before taking legal action. This does not stop either side from seeking interim relief from a court, and it does not affect your right to go to court at any time.

We are not obliged and not willing to take part in dispute resolution proceedings before a consumer arbitration board within the meaning of the German Act on Alternative Dispute Resolution in Consumer Matters (VSBG).

23. Corrections

Services information may contain typographical errors, inaccuracies, or omissions. The company reserves the right to correct any errors or update information at any time without prior notice.

24. Conformity, Updates, and Your Statutory Rights

We owe you the services in the agreed quality and free of defects, for the whole duration of the agreement. Your statutory rights in respect of digital products under §§ 327 ff. of the German Civil Code apply in full and are not limited by these terms.

What that means in practice:

  • The services must have the agreed features and the quality that is usual for a service of this kind and that you can reasonably expect. What the services do is described in these terms and in the app.
  • We will supply the updates, including security updates, needed to maintain that state during the agreement, and inform you about them (§ 327f of the German Civil Code). If you fail to install an update we have told you about within a reasonable period, we are not liable for a defect that results solely from the missing update, provided we informed you of the update and of the consequences of not installing it.
  • If the services are defective, you can demand that we put them right. If we fail to do so, or fail to do so within a reasonable period, you can reduce the fee or terminate the agreement under §§ 327m and 327n of the German Civil Code, and claim damages under section 25.

Please tell us about defects. Report anything that looks wrong to legal@blablapal.com or through the bug report function in the app, so we can fix it.

AI output and defects. What we owe is the provision of AI-generated material for language practice, as described in section 2. It is inherent in the technology, and stated openly there, that an individual answer, correction, translation, or article may be wrong. A single incorrect AI output is therefore not in itself a defect in the services. This does not affect your rights if the services as a whole do not have the agreed or the objectively required quality.

25. Limitation of Liability

We are liable without limitation:

  • for damage caused intentionally or by gross negligence;
  • for injury to life, body, or health;
  • under the German Product Liability Act (Produkthaftungsgesetz);
  • where we have fraudulently concealed a defect or have given a guarantee.

For slight negligence, we are liable only for breach of a material contractual obligation — an obligation whose fulfilment makes the proper performance of this agreement possible in the first place, and on whose fulfilment you may regularly rely. In that case our liability is limited to the damage that is foreseeable and typical for this kind of agreement.

Any further liability is excluded.

These limitations apply equally to our legal representatives, employees, and other agents, and they apply to claims of every kind, whether contractual, tortious, or otherwise. They do not alter the statutory rules on the burden of proof, and they do not affect your rights under section 24 or your statutory rights as a consumer.

26. Indemnification

If a third party brings a claim against us because of something you did — in particular because of your Contributions, your use of the services, a breach of these Legal Terms or of your representations and warranties, a violation of a third party's rights, or a harmful act toward another user — you will indemnify us against that claim and against the reasonable costs of legal defence, to the extent you are responsible for the claim. We will notify you of the claim without undue delay, give you the opportunity to comment, and will not settle it without your consent, which you may not unreasonably withhold.

27. User Data

We store the data you transmit in order to provide the services, and we run routine backups. That does not make us an archive: where content matters to you, keep your own copy, and export anything you want to keep before deleting your account (section 19).

If data is lost or corrupted, we will restore it from the most recent backup as far as that is possible. Our liability for data loss is governed by section 25; the earlier waiver of claims for data loss no longer applies.

28. Electronic Communications

Visiting the services, sending emails, and completing online forms constitute electronic communications. You consent to receiving from us, in electronic form, the notices, agreements, disclosures, and other communications provided for in these terms — by email to the address registered with your account, or as a message in the app. Where these terms or the law require text form (§ 126b of the German Civil Code), an email satisfies it. Statutory requirements of written form under § 126 of the German Civil Code are unaffected. You can withdraw your consent to electronic communication at any time for the future, in which case we may terminate the agreement under section 19 if electronic delivery is technically necessary.

29. California Users and Residents

If a complaint cannot be satisfactorily resolved, California residents may contact the California Department of Consumer Affairs, Division of Consumer Services, Complaint Assistance Unit at 1625 North Market Blvd., Suite N 112, Sacramento, California 95834 or by telephone at (800) 952-5210.

30. Miscellaneous

These Legal Terms and any policies posted by the company on the services constitute the entire agreement between you and the company. The company's failure to enforce any right or provision shall not constitute a waiver of that right or provision.

Transfer of this agreement. We may transfer this agreement, with all rights and obligations, to another company, in particular in connection with a sale or restructuring of the business. We will notify you in text form at least 30 days in advance. You may then terminate the agreement free of charge with effect from the date of the transfer, and we will refund prepaid fees for the remaining period pro rata.

Changes to these terms. We may amend these Legal Terms where there is a valid reason, such as a change in the law, in case law, in our services, or in our providers. We will send you the new version in text form at least 30 days before it is to take effect, and point out what has changed and that you may object. If you do not object before the date given, the new version applies; if you object, the agreement continues on the existing terms and either side may terminate it with effect from that date. An amendment that shifts the balance of the agreement in our favour in a material way requires your agreement.

If any provision is found unlawful or unenforceable, it will be severed and the remaining provisions will continue in full force; the statutory rules take its place.
